Introduction
Two California laws may affect manufacturers' use of packaging materials for electronics products sold or offered for sale in California.
- California's Rigid Plastic Packaging Container Law (part of the California Waste Management Act of 1989) requires that RPPCs sold or offered for sale in California meet one of four recycling, reuse, or reduction criteria.
- The Toxics in Packaging Prevention Act prohibits product packaging or packaging components that include: (1) an intentionally introduced regulated metal; or, (2) regulated metal(s) whose combined incidental presence exceeds 100 parts per million by weight. Regulated metals include lead, cadmium, mercury, and hexavalent chromium.
In addition, several California laws may impose labeling requirements on electronic products, including:
- The Electronic Waste Recycling Act of 2003;
- The Dry Cell Battery Management Act; and,
- The Perchlorate Contamination Prevention Act; and,
- Proposition 65.
