Is it necessary to mark consumables of EEE with the dustbin, to be compliant with WEEE 2002/96/EC ?

The marking requirement under Article 10(3) of the WEEE Directive applies to EEE. EEE, in turn, is defined in Article 3(a) with reference to (i) dependence on electric current or electromagnetic fields to work properly and (ii) the Annex 1A categories. Consumables do not necessarily meet the test under (i), nor are they likely to fall under any Annex 1A category. If that is the case with respect a particular consumable, it is not subject to the marking requirement.
